HC stays demolition of shops along Kalka-Shimla highway

Friday, December 14th, 2007

Chandigarh: The Punjab and Haryana High Court has stayed the demolition of shops along the Kalka-Shimla highway till December 20. The stay may spell relief for owners of 24 shops on the road.

Earlier, the HC had said that the shops on the highway were hindering smooth flow of traffic and had to be removed. Immediately after this, the shopkeepers had moved the High Court.

The petition today came up for hearing before Justice J S Khehar as the Chief Justice is on an official visit to China.

The shopkeepers’ counsel told court that they were owners of the property and not encroachers. He said the shopkeepers possessed the property.

Challenging the demolition orders, the counsel argued that Kalka had come into existence in 1880-1890 along with the then Kalka-Shimla cart road.

This road was later renamed National Highway 22, said the counsel.

The counsel submitted that the shopkeepers had set up their shops on the other side of the drains, which were constructed more than a 100 years ago.

Govt mulls regulator for level playing field

Friday, December 14th, 2007

Chandigarh: Worried over the fate of hundreds of its mandis facing threat from private players, the state government is likely to recommend setting up of a regulatory body.

The regulator clause is likely to be incorporated in the amendments proposed to be made in the Agricultural Produce Market Committee (APMC) Act. The draft Act so far does not talk about a regulator, an official said.

A meeting in this regard, chaired by cabinet minister S S Langah, was held recently. The minister, who was apprised of the draft, wants some time to deliberate on the subject. “If the ministers clear it well in time, only then will this go to the meeting of the state cabinet,” an official said.

The government is in the process of amending the APMC Act as suggested by the Centre. The amendments will open doors for the non-public sector to set up private markets in Punjab.

At present, the prospects of such a market have remained confined to the domain of the Punjab Mandi Board. Corporate major Bharti has already presented its case for a similar venture. However, the company will have to wait till the Act is amended in the state.
